Justice John Okoro, who presided over a five-judge panel, dismissed the appeal on Thursday, following Professor Shija’s withdrawal.
The panel dismissed it because it was statute barred.
The Supreme Court also heard an appeal filed by Missus Aida Ogwuche of the People’s Democratic Party (PDP) in Benue State, who is running for a seat in the House of Representatives.

Mister Adeboyega Awomolo, her counsel, is asking the court to reinstate her as the PDP candidate for the Ado/Okpokwu/Ogbadibo Federal Constituency in Benue State.
Mister Francis Agbo, her opponent, wants the court to dismiss the appeal, claiming that Missus Ogwuche violated the law by refusing to resign from her position at the Federal Inland Revenue Service (FIRS) at the time she ran for office.
After hearing the parties’ arguments, the Supreme Court set February 22 as the date for its decision.
